Terms of Service

1. Early Access; eligibility (13+)

The Service is offered in Early Access / public beta and may change, break, or be discontinued without notice. You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms. We do not knowingly collect personal information from children under 13 (see also our Privacy Policy).

2. Private events; accounts; host responsibility

ToastWall events are private: guest and venue access requires an Event Code (or invite link that includes it) that the host controls. The event URL/slug alone is not enough. Hosts manage events by signing in with Google. Guests may use the same Google sign-in only for album Download and Visited Albums / History. Join, upload, like, and Contribute stay Event Code or device-cookie based and do not require Google. Legacy events may be claimed once with an old organizer password, then managed with Google. Venue displays use the Event Code, not a host password.

ToastWall is a platform. We are not the host of your physical event, not a publisher that reviews all uploads in advance, and not a party to disputes between hosts and guests arising from content or Event Code sharing.

As host (organizer), you are responsible for:

• Who receives the Event Code / join links, and how the venue wall URL is displayed
• Guest conduct and uploads at your event; using hide, restore, and delete tools we provide
• Consents for photos/video at your event, including people who appear in a guest’s shot, and claims about guests’ content (IP, publicity, privacy)
• Not posting the Event Code publicly if you want the room to stay private. We design for private links but are not liable if you publish the code
• Downloading your album ZIP within 30 days after you mark Event over

3. Fees; pay-to-open; refunds

The published price is $60 per event. Payment (or a completed free promo on Stripe) is required before you create an event and opens guest access with that event. Payment is processed by Stripe on a hosted checkout page (ToastWall does not store full card numbers). Issued Stripe promotion codes may reduce the total to zero; in that case Stripe does not collect a card. Once guest media is flowing, or guest access has been opened by pay or promo, fees are generally non-refundable. If checkout fails or you were charged in error before guest access opened, contact support@toastwall.com.

4. As-Is; no warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content will be preserved.

5. Retention; no long-term archive; data loss

We do not promise backups or long-term archival. After you mark Event over, we keep event media/album up to 30 days. A prepared album ZIP is kept about 14 days (separate from album retention). Hosts must download their ZIP within that window. When retention enforcement is enabled, media may be purged after that window. Events still in progress are not auto-deleted solely for that reason. We are not liable for loss of content.

6. Acceptable use

You agree not to use the Service to:

• Upload unlawful, harassing, hateful, or pornographic content
• Infringe others’ intellectual property or privacy rights
• Attempt to access events or media without a valid Event Code
• Probe, scan, or disrupt the Service or related infrastructure
• Upload malware or automated spam
• Impersonate others or misrepresent your affiliation

We may remove content, end events, or suspend access for violations.

7. Your content; licenses

You retain ownership of content you upload. ToastWall does not take copyright.

You grant ToastWall a worldwide, non-exclusive, royalty-free license to host, process, display, and transmit that content solely to operate the Service: the event screen, album, moderation, guest Download, host ZIP, and host Google Photos export. We do not use guest uploads to advertise ToastWall, sell them, or train AI.

When you upload to an event, you also grant that event’s host a worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, and create event recaps from that content for the event and for the host’s own publicity and marketing (including social posts, websites, press, prints, and Google Photos). The host may not sell your files as standalone stock media or license them for uses with no connection to the event or the host’s business.

This host license is from the uploader of the file. It does not clear every person who appears in the shot. Hosts remain responsible for likeness and venue photo notices.

If a guest later deletes an upload on ToastWall, that may stop future use through the Service. It does not require the host (or anyone they already shared with) to retrieve copies already downloaded, exported, printed, or posted. We may still remove content for abuse, legal, or operational reasons.

8. DMCA safe harbor

We respect intellectual property rights and respond to notices under the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a notice to privacy@toastwall.com including: (a) your contact information; (b) a description of the work claimed to be infringed; (c) the URL or location of the allegedly infringing material; (d) a statement that you have a good- faith belief the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act; and (f) your physical or electronic signature. We may remove or disable access to material and, in appropriate circumstances, terminate repeat infringers.

9. Indemnification

You agree to indemnify, defend, and hold harmless ToastWall, its operators, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the Service, your sharing of Event Codes or links, or your violation of these Terms or applicable law, including disputes between you and your guests.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ToastWall AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR FOR DISPUTES BETWEEN HOSTS AND GUESTS ARISING FROM CONTENT OR EVENT CODE SHARING. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

11. Privacy

Our Privacy Policy describes how we handle personal data. Deletion requests: email privacy@toastwall.com; we aim to complete them within 30 days.

12. Changes

We may update these Terms. Continued use after changes become effective constitutes acceptance. Material changes for hosts may also be noted on the Service or by email when we have contact details.
